Who makes local laws?

1 min read

Overview

  • There are many additional local rules that are needed for many topics.
  • The 3L Philosophy does not prescribe who or how such local rules are made, adjudicated or enforced, only that they harmonise with the Legal Principle.
  • Local communities may choose to use some form of voting system to determine their interpretation of grey area topics and accompanying rules, or some other method. The 3L Movement does not presume to know better than its members on how they wish to organise their community.
  • One thing is for certain: no local community may create or impose laws on others that violate the Legal Principle.

Imperfection is guaranteed

  • 3L does not promise a utopia. It is unavoidable that some people may not agree with their community’s opinion on grey areas. In general, society would be vastly more free no matter what reasonable interpretation is adopted. Victimless crimes would be abolished and actual victims would enjoy full protection of their right to live free by the law. Therefore the worst case scenario for someone who disagrees with other reasonable people on where to draw the line on the outer contours of grey areas, is still a great improvement on the unjust laws we must adhere to today. They can choose to:
    • Tolerate the disagreements and continue living in the community.
    • Move to a different local community that better aligns with their values.
    • Succeed from the wider community, despite the higher costs (including from the costs of adjudicating and enforcing the laws being shared by a smaller number of people) entailed in doing so. This option also does not resolve all issues – what level of noise is acceptable and other de minimus trespass disputes may remain an issue even after succession.
